MyVista Ltd Terms and Conditions
By accessing this website and/or placing an order you agree to be bound by the terms and conditions set out below. If you do not agree to be bound by these terms and conditions you may not use or access this Website. By placing an order you are in acceptance of abiding by the websites terms and conditions.
MyVista ltd reserve the right to vary these Terms at any time. Should MyVista Ltd do so, the updated version will be posted on the website and you will bound by the updated version if you continue to use the Website thereafter.

Goods Information
MyVista Ltd tries to make all reasonable efforts to accurately display sizes, colours and shapes of all the items for sale on the website. You however acknowledge and accept that sizes, colours and shapes shown are approximate only. Colours in particular may differ due to your own computer visual settings and hardware.
If for whatever reason the items we deliver are not what you ordered, are damaged, an incorrect quantity or defective once received, we shall have no liability to you unless you notify us in writing (this can be by email to info@indicare.co.uk) within seven working days starting from the date immediately after the delivery of the goods in question. Our only obligation will be, at our option only to:
1. make good any shortage, non delivery or incorrect delivery or
2. replace or repair any items that are damaged or defective, or
3. refund you the amount that you paid for the items, the above obligations shall not apply should such damage occur or defect has arisen as a consequence of any negligence by you or your failure to comply with any reasonable instructions issued by us.
We will not be liable to you for any indirect or consequential loss, damage or expenses ( including loss of profits, business or goodwill) howsoever arising. Without prejudice to the foregoing, our total aggregate liability to you under and/or arising in relation to the Contract shall not exceed the amount paid by You for the Goods.
You must comply and observe with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our Website. The importation or exportation of certain of our items to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the items you may purchase.
Notwithstanding the above, nothing in these Terms and conditions is intended to limit any rights you may have as a consumer neither under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
Order Confirmation and Delivery
Once an order has been placed with MyVista Ltd, you will receive an email of confirmation.
Orders will be actioned once full payment has been received.
We aim to despatch your order within 48 hours of receipt of full payment to your address, stock permitting unless we notify you. Most items should reach you within 3 - 5 working days, however MyVista Ltd can not be held responsible for any delays due to postal services. We endeavour to keep all items in stock, however if part of an order is not available for whatever reason after we have accepted it, we will notify you immediately. Once the order has been received you will become the owner of the items and will be held by you at your own risk, we will not be liable for their loss or destruction.
We will not deliver to any PO Box address, we also reserve the right not to deliver orders should we believe the address not to be secure e.g. communal addresses.
Events beyond our control
We shall have no liability to you for any failure to deliver items that you have ordered or any delay in doing so or for any damage or defect to items delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs, terrorism and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
Prices
All Prices are inclusive of VAT but do not contain delivery charges
All delivery charges are indicated separately and inclusive if VAT.
The price payable for any items that you order are set out on the website.
Prices can be subject to change without notice, however this will not affect orders that have already been accepted.
Prices are exclusive of any import or export duty.
Payment
Before your order can be accepted we must have received full payment of the whole price for the items that you have ordered. To place orders please follow the directions on the website. Until whole payment of items in the order have been made and the funds have cleared in respect of the full amount the items will not be deemed paid. Once payment has been received we will confirm your order by email provided by yourself during the order process.
Payments will be made by using Paypal.
Cancellation/Returns
The UK's Consumer Protection (Distance Selling) Regulations allow you to cancel your contract within 7 working days from receipt of goods. You have the right to cancel your order right up until items have been dispatched and a full refund will be made. Once an order has been received you should inspect your items immediately and notify us within 7 days of receipt of delivery should your purchase be damaged or not comply with what you have ordered. If for any reason you are not completely satisfied with your purchase upon receipt you may cancel your order at any time up to the end of the seventh working day starting from the date immediately after you received your order. Should we not hear from you within the 7 days you have been deemed to have accepted the order. To return your order and receive a full refund you can do so provided the goods are unopened and sealed in the original packaging, unused and in no worser condition than when you received it. Unfortunately we are unable to refund return postage unless the item is faulty. Orders must be sent back to MyVista Ltd and at your own cost and risk.
If you wish to cancel you must do so by putting it in writing before the end of the period set out above, this can be done by email to info@indicare.co.uk. Please include in the email your details and order reference. Should the item already be dispatched you will need to repackage and return to MyVista Ltd in order to receive your refund. Please ensure that you obtain a receipt for proof of postage. Should the item not be received by MyVista Ltd and no evidence of proof of postage, unfortunately a refund can not be made. Should you be unable to deliver the item for refund please advice and MyVista Ltd can arrange for collection at your cost.
MyVista Ltd regrets that we cannot be held liable for returned parcels which are lost or damaged in the post.
We will endeavor to make refunds as soon as possible but in any case within 30 days upon receipt of your notification. Credits will be made in the manner in which they were paid.
Cancellation by Us
We reserve the right to cancel the Contract for the reason below, if:
1.we do not deliver to your area or country; or
2. we have insufficient stock to deliver the goods you have ordered; or
3. if one or more of the goods you ordered was listed with incorrect information including without limit price, and/or description for whatever reason; or
4. if we have reason to believe that you will fail to pay for the goods or that you will not comply with these Terms.
Privacy Policy
Your privacy is very important to us. Personal information held by MyVista Ltd may include name, address, telephone number and email address. This information is only collected from you when you provide information by telephone, subscribing to our eNewsletter or email to MyVista Ltd.
Should you wish to Unsubscribe to our eNewsletter at any time please do so by clicking the relevant link on the eNewsletter.
This information may only be used by MyVista Ltd to inform you of a change to the website or to keep you posted on events and new products. We will not your personal information to any third party.

Should you have any complaints with regards to the site or the items in this site please express them and please get in contact.

Any advice given on our website or material is not a substitute for medical advice or effective First Aid training. MyVista Ltd highly recommends that First Aid Training be undertaken by all parents and carers of infants and children.

MyVista Ltd shall not be liable for any consequential loss whether this arises from breach of duty in contract or any other way, any claim shall not exceed the price of the goods supplied. Also MyVista shall not be liable for any of the following damage or losses regardless of whether they were foreseeable, foreseen or known, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, and whether in tort including without limitation negligence, contract or otherwise, loss of data; loss of revenue or anticipated profits; loss of business; loss of opportunity; loss of goodwill or injury to reputation; losses suffered by third parties. This does not affect you statutory rights.

You also agree not to adapt, alter or create a derivative work from the website content except for your own personal, non-commercial use. Any use of the website will be done so and you agree to use only for lawful purposes and only in a way that does not infringe the rights, inhibit or restrict anyone else.
